A CUSTOMER is understood to be any natural person with the legal capacity to enter into a valid contract under the applicable law.

You may not use the website or accept these terms and conditions unless you are of legal age, have the legal capacity to enter into a binding contract, and qualify as a CUSTOMER as described above.

The sale of YSTANMIEL products is permitted exclusively to users residing in Spain. Use of this website, as well as any purchase made through it, shall be deemed to have taken place in Spain and shall therefore be subject to current Spanish laws and regulations. Orders outside the aforementioned territories are neither accepted nor delivered.

Preface

This e-commerce website is wholly owned by YSTANMIEL, together with all associated rights. Any systematic reproduction of this website, whether in whole or in part, is subject to prior authorisation from YSTANMIEL. However, hyperlinks to the website are permitted without prior notice.

By placing an order, the CUSTOMER acknowledges that they have read the General Terms and Conditions displayed on this page and expressly agrees to them without reservation. These General Terms and Conditions govern the contractual relationship between YSTANMIEL and the CUSTOMER and are accepted by both parties without reservation. These General Terms and Conditions shall prevail over any other conditions contained in any other document, unless expressly waived in writing beforehand.

2. Products

Product images, descriptions and names are provided for guidance only and may contain errors. They may not always provide an exact representation of the product and, therefore, the images illustrating the products are not contractually binding. Should an error occur, YSTANMIEL shall under no circumstances be held liable in relation to this matter. Most of the products offered to customers by YSTANMIEL are available in our warehouse.

3. Orders

The automatic registration system shall be considered proof of the nature, content and date of the order.
YSTANMIEL confirms acceptance of the order by email to the address previously provided by the CUSTOMER. The sale shall only be deemed complete once the order has been confirmed by YSTANMIEL.
YSTANMIEL shall not be held responsible for being unable to deliver an order where the CUSTOMER has entered incorrect information when placing it.

As it is the CUSTOMER’S responsibility to enter all information correctly before confirming the order, any additional costs arising from the shipment having to be redirected by the relevant carrier due to an incorrect postcode or delivery address entered by the CUSTOMER shall be paid by the CUSTOMER and not by YSTANMIEL

Similarly, for telephone orders, it is the CUSTOMER’S responsibility to check the order-confirmation email immediately after the call and verify that the requested products and all delivery and contact details are correct.
Any error made by the person who placed the order on the CUSTOMER’S behalf must be reported immediately by email or telephone. Otherwise, any costs arising from the return or exchange of a product, or the redirection of the parcel due to an error in the order, shall be paid by the CUSTOMER.

Where the carrier returns a shipment because the maximum holding period at the destination depot has expired without the parcel having been delivered or collected, or because the recipient refuses a shipment that has already been paid for, the total value of the order shall be refunded, less the shipping costs, whether or not they were listed on the invoice. A further amount of €4.95 shall also be deducted to cover the carrier’s return-processing costs.

In cases involving returned or uncollected cash-on-delivery orders, subsequent orders may only be dispatched once payment has been made in advance by bank transfer or deposit, debit or credit card, or PayPal.

YSTANMIEL reserves the right to cancel any order placed by a CUSTOMER with whom there is an ongoing commercial dispute relating to payment for a previous order.

YSTANMIEL YSTANMIEL provides customer service by telephone and/or email.
Where a change to an order or its cancellation is requested, delivery cannot be stopped if the parcel has already been invoiced and dispatched from our facilities. In such cases, the matter must be resolved after delivery.

By placing an order, the CUSTOMER agrees to receive informational emails concerning order confirmation, order preparation, shipment tracking and requests to review the products purchased.

4. Delivery

All orders delivered by YSTANMIEL are intended for the CUSTOMER’S personal use. Customers and product recipients are not entitled to resell all or part of the products.
Delivery shall be made directly to the recipient or, in their absence, to another person authorised by the CUSTOMER.
A possible delay in delivery shall not entitle the CUSTOMER to claim damages.
War, civil unrest, fire, strikes, accidents and an inability to obtain supplies shall be regarded as force majeure events releasing the seller from its obligation to deliver the requested order.
Goods are always transported at the recipient’s risk. Always check the condition of your order upon receipt. You have 48 hours to submit any claim to the carrier in the event of missing or damaged goods.

5. Returns Policy

You have seven calendar days from delivery to inform us that you wish to return all or part of your order under your right of withdrawal.
Products must be returned in perfect condition. Where products are returned opened and/or without their original packaging, the amount refunded shall be reduced to reflect any depreciation in their value.
You may return the product using Correos or a carrier of your choice, with shipping costs paid by you.

The total amount paid, or the amount corresponding to the returned products, shall be refunded using the same payment method used for the order. The refund shall be processed once the batch numbers, expiry dates and condition of the products have been checked at our facilities, taking the preceding paragraph into account.

You may return all or part of your order if you have received a defective product or a product different from the one ordered. You must notify YSTANMIEL by email at ystanmiel@hotmail.com stating

• Order number, or full name and order date.
• Products to be returned.
• Contact telephone number.

No return shall be accepted unless it has first been notified in writing to ystanmiel@hotmail.com.
Once the return has been reported and approved by the customer service department, the goods must be sent back properly packed and protected against damage during transit. A written note stating the reason for the return and identifying the order associated with the products must be placed inside the parcel.

6. Prices

Prices are stated in euros (€).
Prices shown on product information pages do not include shipping costs.
The price shown in the order confirmation is the final price, including all taxes and shipping costs.

7. Payments

Customers may choose from four payment methods. All are 100% secure and use SSL encryption:

• Visa, Mastercard or other debit or credit cards.
• PayPal or Express Checkout.
• Bank transfer or deposit into our bank account, stating the order number in the payment reference.
• Cash on delivery, subject to an additional fixed charge of €2.95.

An order confirmed by the CUSTOMER shall only become effective once the relevant banking institutions have approved the transaction. If approval is refused, the order shall be cancelled automatically. YSTANMIEL is not informed of the reasons why the banking platform may refuse a transaction.

8. Disputes

These terms and conditions have been drafted in Spanish and are governed by current Spanish law.
For the resolution of any disputes, the parties submit, at their discretion and expressly waiving any other jurisdiction, to the courts and tribunals of the city of Madrid.
In the event of a dispute, the CUSTOMER shall first contact the company in an attempt to reach an amicable solution.
Before taking legal action, the CUSTOMER may seek an amicable settlement with the assistance of a relevant professional association, consumer association or other advisory organisation.

9. Guarantee

The “best before” dates stated on the products must be observed by the CUSTOMER.
In all cases, YSTANMIEL shall not be held responsible for any failure to comply with the provisions of applicable laws and regulations.
YSTANMIEL’S liability shall automatically be limited to the value of the product concerned at the date of purchase, without the possibility of bringing a claim against the brand or company that manufactured the product.

11. Additional Terms

If any provision of these terms and conditions is deemed invalid or unenforceable, that provision shall be removed, while the remaining provisions shall continue in full force and effect.
